General

The following Terms & Conditions shall apply to the relationship between Mirkhiya Auction , Surat-395007 Gujarat, India and all subsidiaries of Mirkhiya Auction , Mirkhiya Auction and the end user ("You" or "Your"). By using ‘Mirkhiya Auction’ services, you accept the following Terms and Conditions, as well as the manner in which Mirkhiya Auction operates. These Terms & Conditions constitute the entire agreement between Mirkhiya Auction and You, undertakings or representations, whether written or oral, between You and Mirkhiya Auction ,with respect of Your use of Mirkhiya Auction.

Information on Mirkhiya Auction. such as the "How to Works" section, are only recommendations and are not intended as guidelines. Mirkhiya Auction is not liable or responsible for the actions of users or other individuals who have read or been informed of such information or other written material.

Mirkhiya Auction undertakes to follow all local tax legislation for the sale of bid payment and goods in the countries in which it operates, such as payment of GST.

Mirkhiya Auction reserves the right to change these Terms & Conditions at any time without prior notice to You.

Acceptance of Terms & Conditions

By accepting the Terms & Conditions and/or registering with Mirkhiya Auction, You confirm that You are eligible (as specified in the "Eligibility" section) to use Mirkhiya Auction.

If You do not agree to the Terms & Conditions, please do not use Mirkhiya Auction.

If You access and use any service from Mirkhiya Auction, You agree to and are bound by these Terms & Conditions.

Eligibility

By accepting the Terms & Conditions and/or registering on Mirkhiya Auction, You confirm that You are at least 18 years of age and at least age of majority subject to the laws of the state, city or other legal entity; therefore You can engage in a binding contract. By using Mirkhiya Auction, You warrant that You have the right, authority, and capacity to enter into this agreement and to abide by all of the Terms & Conditions. By registering on Mirkhiya Auction, the user declares that they are legally capable of entering into binding contracts. Mirkhiya Auction employees and their family members may not, under any circumstances, participate in Mirkhiya Auction’s auction.

Mirkhiya Auction products and services are offered exclusively to all users and not only to commercial or semi-commercial retailers.

Mirkhiya Auction reserves the right to limit the number of user accounts per household.

A user may not use any external software to automatically place bids in the auctions.

Mirkhiya Auction reserves the right, at its sole discretion, to deactivate any user’s account based on suspicion of the use of such software.

Registering

You hereby declare and warrant that You are at least 18 years of age and at least age of majority subject to the laws of the state, city or other legal entity, therefore You can engage in a binding contract; You reside in a jurisdiction in which Mirkhiya Auction operates; Your user account may be used only by You and not by anyone else. All information that you provide us during the term of validity of this agreement, is true, complete, and correct, and that you shall immediately notify us of any change of such information.

You are allowed to have only one account. If you attempt to open more than one account, all accounts you try to open may be blocked or closed.

As part of the registration process you will have to choose your username and password for your login to Mirkhiya Auction.

During the registration process, you must choose a username, which must not in any way be offensive, indecent, insulting or intended to deceive or mislead other users or persons, whether intentionally or unintentionally.

Nor may a user name advertise for or promote any other websites or services, provide links to or for other websites.

Please note that Mirkhiya Auction reserves the right to change usernames, for whatever reason, and is the final arbiter on policy.

Mirkhiya Auction will never ask for Your password apart from login. You are solely responsible for Your user account password and its preservation. We suggest that you not provide your password to anyone, including ‘Mirkhiya Auction’ employees. User accounts are non-transferable.

We are not responsible for any abuse or misuse of your account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.

Bidding

Users can place bids by manually clicking the relevant bid button. Mirkhiya Auction reserves the right to offer different Bid at different times. All placed bids are non-refundable.

How the Auctions Work

With each bid placed, the price of the item on which the user is bidding decreasing by a small preset amount (multiple of Rs.0.01 INR up to Rs.1 INR ).An auction closes when no more bids are received by Mirkhiya Auction’ servers. The countdown time is indicated for each auction. Due to the time it takes for bids to reach Mirkhiya Auction’ servers, and in order to allow all users the same opportunity to bid regardless of geographic location.

The user who was the last to place a bid wins the auction and can purchase the product.

Bids become valid when they are entered in the Mirkhiya Auction database and registered in Mirkhiya Auction’ system. Mirkhiya Auction is not responsible for disruptions in the user’s connection and errors that may occur as a result of this. This includes, but is not limited to, incorrect countdown of the remaining time, outdated information on bidders, and bids.

Buy Now Option

We may, at our sole discretion, also offer users a "Buy Now" option. The Buy Now option allows a user to buy the product Instantly. It gives the user the option to purchase the product by paying the product value, which is the suggested retail price. The user can buy the product using the Buy Now option at any time when the auction is online. When a user decides to buy the product by exercising the Buy Now option, he/she may no longer to wait . You can buy product instantly & enjoy .The auction will continue uninterrupted for all other users. All purchases pursuant to a Buy Now option shall be subject to the user’s payment in full of all amounts due for the product (including all shipping and handling charges) within 24 hours.

Acceptance of the Win - Payment

Once an auction is closed, the winner, goes to My Account for information on the total price, including shipping costs, and payment options. Once the auction is closed, the winner has 5 days to pay the total price of the product, by following the steps indicated on the website. After confirming the win and paying the amount due, the winner will receive a confirmation e-mail. Mirkhiya Auction will ship the product within 7 working days after payment confirmation is received. The buyer must also provide an accurate delivery address on the account, before Mirkhiya Auction can ship the product. After Mirkhiya Auction has shipped the product, it will take a few days for it to reach the buyer.

If an auction win has not been confirmed and paid within 5 days, the order will be void and cancelled, spent bids will not be refunded.

Delivery

Unless otherwise specified, delivery will be made from our supplier’s warehouse to the registered address provided by the User.

Deliveries are made solely within India.

As Mirkhiya Auction works with trusted delivery partners to ensure the best possible service and widest reach, all delivery estimates are for information only and do not constitute binding agreements. Obvious damage to the item or packaging during transit should be reported to the carrier by the winning user, if the item is damaged it should be refused, not signed for. If you wish to claim for concealed defects or damage after signing for an item, you must inform us about the damaged or faulty goods within 3 days of receipt. Mirkhiya Auction cannot accept responsibility for damaged or faulty goods once 3 days have lapsed. In all cases you must inspect your item either at the point of or immediately after delivery. Failure to raise a query with Mirkhiya Auction, concerning a damaged or incorrect item within 3 days of delivery constitutes acceptance of the item as is. Mirkhiya Auction does not accept liability for damage or failure of products due to neglect or misuse by the recipient. In the event that Mirkhiya Auction’s delivery partners are not able to deliver the item within a reasonable time, Mirkhiya Auction shall be entitled to offer the winning User a substitute item with comparable or better features, or to set aside the contract through recission and offer a refund of any payments received for the auction item. This does not affect the User’s statutory rights.

Returns - Refunds

The product will be delivered to the address specified by the user. All technical service and product support matters must be taken up directly with the manufacturer according to their terms. In case of cancellation of an order, only the purchase price will be refunded.

So, shipping costs and spent bids will never be refunded. This policy applies only Buy Now option. If you decide to return a product/item, Mirkhiya Auction will not refund the value of the placed bids of a purchased product/item.

Account Termination

TERMINATION BY YOU : You may close your account at any time by sending us notification of your intention.

TERMINATION BY MIRKHIYA AUCTION : Mirkhiya Auction reserves the right to temporarily or permanently terminate Your account at its sole discretion if it determines You have violated these Terms & Conditions, any laws, or the rights of our other users or other third parties. Examples of unauthorized usage include the use of unauthorized third-party bidding or bid tracking software, the creation of multiple accounts by the same individual, or if Mirkhiya Auction suspects fraudulent account activity or behavior.

You agree that if Mirkhiya Auction, in good faith and in its sole discretion, determines that You have breached these Terms & Conditions, Mirkhiya Auction may withhold, cancel or otherwise retain any and all of Your pending deliveries and/or refunds for bids.

Damages - Errors - Limits on Liability

Claims for damages by the User against Mirkhiya Auction, its legal representatives, employees or parties who assist in performance are not permitted. In particular, Mirkhiya Auction shall not be liable for faulty operation of the phone or computer hardware/software during bid submission and for incorrect/slow transmission of bidding data by phone/ISP. Should such an event occur, the User shall have no legal rights over the item. User expressly agrees that use of Mirkhiya Auction is at user’s sole risk.

Mirkhiya Auction does not guarantee any results that may be obtained from the use of the website. Mirkhiya Auction cannot guarantee continuous access to the service. While we will use all reasonable endeavours to keep an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services. In the event that an auction has closed irregularly, Users will be refunded the bids spent for the item and the auction will be resumed at a later time. Mirkhiya Auction will do its best to notify the User that the auction has closed irregularly as soon as possible. After a technical error, Mirkhiya Auction has the right to may be restart all auctions from the beginning, once the problem has been rectified. Anyway, Mirkhiya Auction will do its best to restore the users’ which is, however, not guaranteed.

Applicable Law

These Terms & Conditions shall be governed and construed in accordance with the laws of India.
